Apple is removing its latest smartwatches, the Watch Series 9 and Watch Ultra 2, from both online and in-store shelves within the next week. Despite being released just three months ago, the company is responding to a lawsuit from Masimo, a health tech company. Masimo claims that the blood oxygen sensor in these watches is too similar to their patented technology.

This legal dispute led the U.S. International Trade Commission (ITC) to prohibit the import of these watches, disrupting the supply chain and preventing restocking. A federal judge ruled in January 2023 that Apple’s use of the blood oxygen sensor infringes on Masimo’s patent, resulting in the ITC’s import ban issued in October.

Although Apple has stopped sales, the situation is now awaiting presidential review. President Biden has the authority to veto the ban, but this process takes up to 60 days, with a decision expected by December 25th. However, historical trends suggest that such bans are rarely overturned.

It is anticipated that the import stoppage will be upheld, leading to the demise of the current Apple Watch Series 9 and Watch Ultra 2. Apple may need to redesign the watches without the contested blood oxygen sensing system, potentially making software changes or exploring alternative features.

If you’re interested in purchasing these watches, act quickly. They won’t be available on Apple’s online store after December 21st or in physical stores after December 24th. While retailers like Amazon may still have inventory, the eventual depletion of supplies is inevitable due to the import ban.
